WEBSITE TERMS & CONDITIONS
Website Terms & Conditions
Last updated: 19 September 2026
These Website Terms & Conditions (“Terms”) govern your use of the website operated by Geostar Productions trading as Geostar Digital (“we”, “us” or “our”).
By accessing or using this website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
1. About this website
This website provides information about our creative services, portfolio, projects, photography, video production, motion design, sound, digital content and related services.
The website is intended primarily for general information and business enquiries.
Information displayed on the website does not constitute a binding quotation, proposal, offer or contract for the provision of services unless expressly stated otherwise.
2. Services and quotations
Descriptions of our services, packages, pricing and capabilities are provided for general information and may change from time to time.
A project becomes an engagement only when the relevant proposal, quotation, agreement, statement of work or other written arrangement has been accepted by both parties.
Where a separate client agreement exists, that agreement will govern the relevant project and will take precedence over these website Terms to the extent of any inconsistency.
3. Project agreements
Creative production work may involve photography, video production, sound recording, sound design, motion graphics, editing, colour grading, post-production, digital content and related services.
Project-specific matters such as:
scope of work;
deliverables;
fees;
payment schedules;
production dates;
locations;
revisions;
cancellation or postponement;
usage rights;
licensing;
copyright ownership;
raw footage and project files;
music, stock media and third-party licences;
talent and location releases; and
delivery specifications
will be determined by the applicable project agreement, quotation, proposal or statement of work.
4. Intellectual property
Unless otherwise stated in writing, the website and its contents are protected by applicable intellectual property laws.
This includes, where applicable:
photographs;
video;
audio;
sound recordings;
music;
graphics;
animations;
motion design;
logos;
branding;
written content;
layouts;
artwork;
original creative concepts; and
other materials displayed on the website.
You must not reproduce, copy, modify, distribute, publish, sell, licence, transmit or commercially exploit website content without our prior written permission, except where permitted by law.
The use of third-party materials appearing on the website may be subject to the rights of their respective owners.
5. Portfolio and client work
Examples of completed work displayed on this website may include work created for clients, organisations, agencies or other parties.
Our display of such work does not necessarily mean that we own all underlying intellectual property rights in that work.
Where required, portfolio material is displayed with the appropriate permission, licence or contractual right.
Client-specific intellectual property ownership and usage rights will be governed by the applicable project agreement.
6. Copyright and commissioned work
Copyright ownership in commissioned creative work may depend on the nature of the work and the terms agreed between the parties.
Unless expressly transferred or licensed under a written agreement, intellectual property rights in work created by us may remain with us.
A client's payment for a project does not automatically transfer all intellectual property rights, source files, raw footage, project files or underlying creative assets unless the applicable agreement provides otherwise.
Any copyright assignment or licence will be subject to the terms agreed for the particular project.
7. Client-supplied material
Where you provide us with photographs, video, audio, music, graphics, logos, documents, personal information or other material for use in a project, you are responsible for ensuring that you have the necessary rights, permissions and authority to provide and use that material for the intended purpose.
You agree not to knowingly provide material that infringes another person's intellectual property, privacy, confidentiality or other legal rights.
Where a project requires specific releases, licences or permissions, responsibility for obtaining those permissions will be allocated in the relevant project agreement.
8. Third-party content and services
The website may contain links, embeds or references to third-party websites, platforms or services.
These may include video hosting platforms, social media services, payment providers, software providers, portfolio platforms and other external services.
We do not control those third-party services and are not responsible for their availability, content, security, privacy practices or terms.
Your use of third-party services is subject to the terms and policies of those providers.
9. Website availability
We aim to keep the website available and functioning properly, but we do not guarantee that the website will always be available, uninterrupted, secure or error-free.
We may modify, suspend or discontinue any part of the website without notice where reasonably necessary.
This may include temporary interruptions caused by maintenance, hosting providers, software updates, security issues, technical failures or circumstances outside our reasonable control.
10. Accuracy of information
We make reasonable efforts to ensure that information published on this website is accurate and current.
However, information may change and errors or omissions may occasionally occur.
Website content should therefore be treated as general information rather than a guarantee that a particular service, price, availability, specification or outcome will remain unchanged.
11. No guarantee of results
Creative outcomes depend on many factors, including the project brief, available locations, participants, production conditions, client materials, approvals, timelines and other circumstances.
Unless expressly agreed in writing, we do not guarantee a particular commercial, marketing, audience, search-engine, social-media or financial result from the use of our creative services or website content.
12. Limitation of liability
To the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of, or reliance on, information contained on this website.
This includes indirect or consequential loss, loss of business, loss of opportunity, loss of data or loss of profits, except where such liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under Australian law, including applicable rights under the Australian Consumer Law.
Where liability cannot lawfully be excluded, our liability will be limited to the extent permitted by law.
13. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
Where the Australian Consumer Law applies, you retain all rights and remedies available to you under that law.
14. Indemnity
To the extent permitted by law, you agree to indemnify us against reasonable losses, claims, liabilities and expenses arising from your unlawful use of the website or your breach of these Terms.
This does not apply to the extent that the loss or liability was caused by our own unlawful conduct, negligence or breach of a non-excludable legal obligation.
15. Prohibited use
You must not use this website:
for unlawful purposes;
to attempt to gain unauthorised access to our systems;
to interfere with the security or operation of the website;
to introduce malicious code or harmful software;
to scrape, reproduce or systematically copy website content without permission;
to impersonate another person or organisation; or
in a manner that infringes the rights of others.
16. Privacy
Our collection and handling of personal information is described in our Privacy Statement, which forms part of the information governing use of this website.
By using the website, you acknowledge that personal information may be handled in accordance with that Privacy Statement.
17. Confidential information
Information submitted through the website, including project enquiries and general communications, should not be assumed to be confidential unless we have expressly agreed otherwise.
If your project involves commercially sensitive, confidential or proprietary information, we recommend that confidentiality requirements are established through an appropriate confidentiality agreement or project contract before sensitive information is disclosed.
18. Force majeure
We will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, severe weather, accidents, illness, government restrictions, industrial disputes, infrastructure failure, technology failure, telecommunications outages, cyber incidents or failures of third-party service providers.
Where such circumstances affect an active client project, the parties will work reasonably and in good faith to agree an appropriate alternative arrangement.
19. Changes to these Terms
We may update these Terms from time to time.
The current version will be published on this website with the date of the most recent update.
Changes will apply from the date they are published unless otherwise required by law.
20. Governing law
These Terms are governed by the laws of the State of Victoria, Australia.
You agree that the courts and tribunals of Victoria, Australia, and applicable Australian federal courts, have jurisdiction in relation to matters arising from your use of this website, subject to any mandatory jurisdictional requirements that apply.
21. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally possible.
The remaining provisions will continue to operate to the extent permitted by law.
